Wigan Athletic are in dispute with Velez Sarsfield and are set to report the Premier League club to FIFA if they complete the deal for Waldo Ponce.
The Chilean defender looks set to complete a switch to Latics before the end of the January transfer window, but it seems his club have not sanctioned the move.
The 27-year-old, who has been accused of going AWOL, believes he is free to seal a switch to England.
Club president Fernando Raffaini said: "If Ponce signs a contract with Wigan, we are going to forbid the transfer and report Wigan to FIFA.
"We have already ordered Ponce to show up here and attend training sessions with his team-mates, but he never made any reply to us."
Ponce said: "What is left in my career is to play in Europe. I think this is the right moment for moving."
